Please note: These Terms & Conditions are governed by Austrian law (see § 15 below). This English version is provided for convenience; in case of doubt the German version prevails.
1.1 These T&Cs apply to all contracts, deliveries and services of Aquavital GmbH (the «Seller») concluded via the website poseidum.com.
1.2 Any differing or supplementary terms of the Buyer shall not become part of the contract unless the Seller expressly agrees to their validity in writing.
1.3 These T&Cs are directed primarily at consumers within the meaning of the Austrian Consumer Protection Act (KSchG).
2.1 The presentation of products on the website does not constitute a binding offer but a non-binding invitation to order.
2.2 By submitting the order form, the Buyer makes a binding offer to conclude a purchase contract.
2.3 The contract is concluded once the Seller dispatches the order confirmation or the goods.
3.1 The Seller distributes physical limescale-protection devices for residential use under the POSEIDUM® brand.
3.2 POSEIDUM does not remove limescale from the water. The operating principle is based on a change in the crystal structure of the dissolved limescale (conversion of calcite into aragonite) so that limescale build-up is reduced. The mineral content of the water remains unchanged.
3.3 Transparency notice: The mechanism of physical water treatment continues to be discussed controversially within parts of mainstream science. We note that some of the effects described are regarded by parts of the scientific community as not fully established.
3.4 POSEIDUM is available in the following configurations: 1× (cold water), 2× (cold + hot).
4.1 All prices are quoted in euros (EUR), including statutory VAT and including shipping costs within the EU.

4.3 The Seller reserves the right to change prices. For concluded contracts the price agreed at the time of ordering shall apply.
5.1 Accepted payment methods: bank transfer as well as credit card or SEPA via Stripe.
5.2 The purchase price is due immediately upon receipt of the invoice, unless agreed otherwise.
5.3 In case of late payment, the Seller is entitled to charge statutory default interest and reasonable reminder fees.
6.1 Shipping is from Austria EU-wide (all EU member states as well as Austria, Germany, Switzerland and Liechtenstein within the DACH region).
6.2 Delivery time is generally 3–5 working days from dispatch confirmation within the DACH region, and 5–8 working days in the rest of the EU.
6.3 EU-wide shipping costs are included in the purchase price (free shipping to all EU countries).
6.4 The risk of accidental loss passes to the consumer only upon actual handover of the goods (§ 7b KSchG).
7.1 The delivered goods remain the property of the Seller until the purchase price is paid in full.
8.1 Pursuant to § 11 FAGG, consumers are entitled to a statutory right of withdrawal of 14 days from receipt of the goods, without giving reasons.
8.2 Withdrawal is effected by an unambiguous declaration to the Seller, e. g. by email to .
8.3 Upon effective withdrawal, the Seller shall reimburse all payments received, including delivery costs, without undue delay and no later than within 14 days of receipt of the withdrawal declaration. For the reimbursement the same payment method used in the original transaction will be used, unless expressly agreed otherwise.
8.4 The cost of returning the goods within the statutory 14-day withdrawal period is borne by the Buyer.
9.1 In addition to the statutory right of withdrawal (§ 8), the Seller grants a voluntary 30-day trial period from the day the product is received.
9.2 During the trial period there is no obligation to pay in advance. An invoice is only issued after the 30-day trial period has expired, provided the Buyer chooses to keep the product.
9.3 If the Buyer is not convinced during the 30-day trial period, they may return the product free of charge. A free return shipping label will be provided on request by email to .
9.4 This trial period is granted voluntarily and applies in addition to the Buyer's statutory rights (in particular § 8 right of withdrawal).
9.5 No further voluntary money-back guarantee after invoicing is granted; the trial period under section 9.1 and the statutory rights (in particular § 8 as well as the warranty under § 10) apply exclusively.
10.1 The statutory warranty provisions apply. The warranty period is two years from handover (§ 933 ABGB).
10.2 In case of a justified defect notice, the Buyer is entitled to repair, replacement, price reduction or rescission in accordance with the statutory provisions.
11.1 In addition to the statutory warranty, Aquavital GmbH grants a voluntary manufacturer's warranty of 10 years on material and function from the date of purchase.
11.2 The warranty covers defects in material and function under normal use. Damage caused by improper handling, external force or unauthorised repair attempts is not covered.
11.3 In a warranty case, the defective device will be repaired or replaced with an equivalent one free of charge.
12.1 To maintain optimum function, POSEIDUM should be removed from the water pipe twice a year for 24 hours so that accumulated magnetic particles can detach.
12.2 Installation and removal are possible without tools.
13.1 The Seller is liable for damages only in cases of intent and gross negligence. In cases of slight negligence, the Seller is only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.
13.2 Liability for indirect damage and consequential damage, in particular for lost profits, is – insofar as legally permissible – excluded.
13.3 The above limitations of liability do not apply to damage arising from injury to life, body or health, nor to mandatory statutory liability cases (e. g. Product Liability Act).
14.1 The Seller processes personal data in accordance with the GDPR and the Austrian Data Protection Act (DSG).
14.2 Details on data processing can be found in the Privacy Policy.
15.1 These T&Cs and all legal relationships are governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the rules of conflict of laws.
15.2 The place of jurisdiction for all disputes is Graz, Austria. For consumers, the mandatory statutory rules of jurisdiction apply (§ 14 KSchG).
16.1 Should individual provisions of these T&Cs be ineffective, the validity of the remaining provisions remains unaffected.
16.2 Changes to these T&Cs require written form.
